Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of MySmokeLog (mysmokelog.com), including all features, content, and services offered through the site (collectively, the "Service"), operated by DJL Systems, Inc. ("DJL Systems", "we", "our", or "us").

By accessing or using the Service, creating an account, or clicking "Create account," you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. The Service

MySmokeLog is a personal record-keeping and light social platform for pipe tobacco enthusiasts. It allows registered users to:

  • Log individual smoking sessions, including tobacco, pipe used, duration, ratings, notes, and photos;
  • Catalogue a personal pipe collection and tobacco cellar;
  • View a social feed of public sessions from other users they follow;
  • Maintain a public profile page showcasing their activity.

The Service may include links to third-party retailers (including affiliate links). We are not responsible for products or services offered by third parties.

3. Eligibility

You must be at least 18 years of age to use the Service. Pipe tobacco is an age-restricted product. By creating an account you represent and warrant that you are at least 18 years old and that your use of the Service complies with all laws applicable to you.

The Service is intended for personal, non-commercial use. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

4. Account Registration

To access most features of the Service, you must create an account. When you do, you agree to:

  • Provide accurate, current, and complete information;
  • Keep your credentials confidential and not share your password;
  • Notify us promptly at mysmokelog@djlsystems.com if you suspect unauthorised access to your account;
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or have been inactive for an extended period.

5. Your Content

"User Content" means any text, notes, ratings, photographs, or other material you submit to the Service — including session logs, pipe and cellar entries, profile information, and photos.

You retain ownership of your User Content. By submitting User Content to the Service, you grant DJL Systems a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and distribute that content solely for the purpose of providing and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to the content you submit;
  • Your content does not infringe any third-party intellectual property, privacy, or other rights;
  • Your content complies with these Terms and all applicable laws.

We do not claim ownership of your content. We will not sell your personal information to third parties. We may share aggregated, anonymized, or de-identified data — such as trends in tobacco preferences or session frequency — with research or industry partners. Any sharing of individually identifiable data requires your explicit consent, which you may withdraw at any time.

6. Public Profiles and Social Features

Your profile page (mysmokelog.com/u/yourhandle) and any sessions or entries you mark as public are visible to all visitors, including non-registered users. Please do not include personal information in public content that you would not want to be publicly accessible.

You may follow other users to see their public sessions in your feed. You may control the visibility of your own content through your account settings.

7. Affiliate Disclosures

The Service may display links to third-party tobacco retailers, including SmokingPipes.com. Some of these links may be affiliate links, meaning DJL Systems may receive a commission if you make a purchase after clicking a link. Affiliate links are provided for your convenience and do not affect the price you pay. We only link to retailers we believe are reputable.

8. Acceptable Use

You agree not to use the Service to:

  • Post content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable;
  • Impersonate any person or misrepresent your affiliation with any entity;
  • Scrape, crawl, or systematically extract data from the Service without our written permission;
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
  • Attempt to gain unauthorised access to any account, system, or network;
  • Use the Service to transmit spam, malware, or any other harmful content;
  • Use the Service for any commercial purpose other than as expressly permitted by us in writing.

9. Intellectual Property

The Service and its original content (excluding User Content), features, design, code, trademarks, and logos are the exclusive property of DJL Systems, Inc. and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

The MySmokeLog name and logo are trademarks of DJL Systems, Inc.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We make no representations or warranties regarding the accuracy of tobacco catalogue data, pipe identification, or any AI-assisted features of the Service. These are provided for informational convenience only.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DJL SYSTEMS, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

13. Indemnification

You agree to indemnify and hold harmless DJL Systems, Inc. and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

14. Termination

You may delete your account at any time by contacting us at mysmokelog@djlsystems.com. We will process deletion requests and remove your personal data in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other users, or us. Upon termination, your right to use the Service ceases immediately.

15. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the effective date above and, for material changes, notify you by email or by a prominent notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which DJL Systems, Inc. is incorporated, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that state.
